On February 15, 2007 the second pilot project on legal aid providing was launched in Bila Tserkva.
24 hours a day lawyers will provide free legal aid to all detainees, who are not able to pay for a lawyer by themselves.
Main task of the project is to approbate a new model of providing of free legal aid to people. The project has been implemented in the framework of the Concept Paper of Formation of the Legal Aid System in Ukraine, approved by the Ukraine President’s order No 509/2006 dated June 9, 2006.
Five defense lawyers and one paralegal are going to participate in the project. Defense lawyers will provide legal aid from the moment of detention in the local police and up to the final verdict on the case.
The project manager in Bila Tserkva is the defense lawyer Kikkas V.E., the Head of the Kyiv Regional Police Department Cherednichenko M.V. and the Head of the Bila Tserkva Local Police Department signed an agreement on the cooperation within the project which established additional guarantees for a detained person; such as:
– Access of a lawyer to a detainee before he/she will be interogated by a police officer.
– Possibility to refuse to use lawyer’s services only in the presence of a lawyer;
– Informing of the project lawyers on all cases of detentions.
The agreement includes also a description of the experiment procedure and procedure of involving of a lawyer into the defense of a detained person.
The first such project has been implemented in Kharkiv from September 2006. The next project is to be launched in one of the Western regions of Ukraine.
Implementation of this project resulted from cooperation of the International Renaissance Foundation, Ministry of Justice of Ukraine, Open Society Justice Initiative, Union of Advocates of Ukraine, Victor Pinchuk Foundation, and other organization.
